HireBuddy Terms of Service

Welcome to HireBuddy ("HireBuddy," "we," "our," or "us"). These Terms of Service govern your access to and use of HireBuddy, including Talent Scout, QuickScreen, our websites, applications, APIs, software, and related services (collectively, the "Services"). By creating an account, clicking "Accept," or using the Services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and have authority to bind yourself or the organization you represent.
2. Accounts
You agree to provide accurate information, keep your credentials secure, and are responsible for all activity under your account. Notify HireBuddy immediately of any unauthorized access.
3. Privacy
Your use of the Services is also governed by the HireBuddy Privacy Policy, which is incorporated into these Terms by reference.
4. Subscription & Payment
Paid subscriptions are billed in advance unless otherwise agreed. Subscriptions renew automatically until cancelled. Fees are generally non-refundable except where required by law. Failure to pay may result in suspension or termination.
5. Customer Data
You retain ownership of your resumes, job descriptions, candidate information, search queries, and other data you submit. You grant HireBuddy a non-exclusive license to process your data solely to provide, secure, support, maintain, and improve the Services.
6. Your Responsibilities
You represent that you have the legal right to upload and process Customer Data and are responsible for complying with applicable employment, privacy, and anti-discrimination laws. You remain solely responsible for all recruiting and hiring decisions.
7. Intellectual Property
HireBuddy owns all rights, title, and interest in the Services, including software, algorithms, AI models, workflows, APIs, documentation, trademarks, copyrights, and related intellectual property. Except for the limited license granted herein, no ownership rights are transferred to you.
8. Acceptable Use
You may not reverse engineer, copy, scrape, benchmark, clone, distribute, bypass security controls, or use the Services or their outputs to train or develop competing AI systems or software. You may not use the Services for unlawful purposes.
9. AI Features
HireBuddy uses AI to generate candidate rankings, summaries, recommendations, and recruiting insights. These outputs are intended to assist recruiting workflows only and should not be relied upon as the sole basis for employment decisions. You are solely responsible for all hiring decisions.
10. Third-Party Services
The Services may integrate with or display information from third-party providers and publicly available sources. HireBuddy does not guarantee the accuracy, completeness, or availability of third-party information.
11. Confidentiality
The Services contain confidential and proprietary information. You agree not to disclose or misuse HireBuddy's confidential information except as necessary to use the Services.
12. Feedback
Any feedback or suggestions you provide may be used by HireBuddy without restriction or compensation.
13. Availability
The Services are provided on an 'AS IS' and 'AS AVAILABLE' basis. HireBuddy does not guarantee uninterrupted or error-free operation.
14. Limitation of Liability
To the maximum extent permitted by law, HireBuddy shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages. HireBuddy's total liability shall not exceed the fees paid by you during the twelve (12) months preceding the claim.
15. Indemnification
You agree to defend, indemnify, and hold harmless HireBuddy from claims arising from your use of the Services, your data, your violation of these Terms, or your violation of applicable law.
16. Termination
HireBuddy may suspend or terminate your access for violation of these Terms, unlawful conduct, security concerns, or non-payment. Upon termination, your license ends immediately. Provisions relating to intellectual property, confidentiality, liability, indemnification, and governing law survive termination.
17. Governing Law
These Terms are governed by the laws of the State of Delaware without regard to conflict-of-law principles. Any legal action relating to these Terms shall be brought exclusively in the state or federal courts located in Delaware.
18. Changes to These Terms
HireBuddy may update these Terms from time to time. Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
